Thirty Lakes Watershed District
Board of Managers Meeting
Monday, July 28, 2008

Board Present:  D. Armstrong, T. Ebnet, J. Hampl, K. Svee, B. Yund.  Absent:  none.

Also present were County Commissioner Rosemary Franzen, and Thirty Lakes staff M. Peisch and T. Lauer.

The meeting was called to order at 9:00 a.m. by President Armstrong in the office of the Thirty Lakes Watershed District, 17064 Commercial Park Road, Brainerd, MN.

Agenda:  MOTION BY EBNET/HAMPL THAT THE AGENDA BE APPROVED WITH THE ADDITION OF CLOW STAMPING.  ALL AYE, MOTION CARRIED.

Secretary’s Report:  MOTION BY HAMPL/EBNET THAT THE MINUTES OF THE JULY 14, 2008 MEETING BE APPROVED WITH TWO CORRECTIONS.  ALL AYE, MOTION CARRIED.

Monthly Bills:  MOTION BY EBNET TO PAY THE MONTHLY BILLS.  MOTION DIES FOR LACK OF SECOND.
There was discussion about charges appearing on the A. W. Research bill.  Topic was tabled so that Clow Stamping could approach the Board of Managers.

Clow Stamping:  Present were Doug Buehl of Clow Stamping, Phil Martin and Jessica of Landecker & Associates.  Currently the proposed northern parking area is zoned Agricultural.  This will not be constructed until after the property is rezoned.  A corner of the existing slab now used as temporary storage will be removed to comply with the required 16.5 ft. setback from the wetland.  Clow Stamping has had discussions with Rob Hall of the Crow Wing County Highway Department about possibly closing the northern access near the receiving area and putting in a new bypass lane.

Thirty Lakes Permit #05008, granted to Clow Stamping Company for its 2005 Expansion will be amended to include the new plan to close the southern road access and create the Drainage Area A (formerly indicated as Pond #2).  The Managers reviewed the existing conditions and amended them as follows:

Amended Conditions 7/28/08

1.  The system shall be constructed as presented in the Storm Water Plan dated 6/6/05 and amended Stormwater Plan dated 7/24/08.

2.  The outfall in the Retention Basin 1 will have a 90 degree pipe installed around the outfall entrance to prevent floatable debris from entering the outfall system.

3.  A bottom marker shall be installed in each basin at the lowest elevation.

4.  Sediments shall be removed from the basins when they reach four (4) inches and disposed of according to Crow Wing County, MPCA and EPA rules.

5.  The drain tile lines from Pond #1 shall be installed a minimum of fifteen (15) feet landward from the wetland delineation line.

6.  Drain tile lines shall be cleaned or replaced when sediment reaches a level of two (2) inches in the bottom.

7.  Drainage Basin #1 outfall shall have four hundred (400) feet of fifteen (15) inch perforated drain tile pipe.

8.  A silt fence protecting the wetland to the west and the ditch to the south shall be installed prior to construction of the basin.

9.  The system shall be monitored for three years.

10. All erosion control devices will be installed before construction is started.

11. Sediment levels to be reported to Thirty Lakes Watershed District annually for a period of three years.

12. Permit #05008 valid through 7/28/2011, subject to extension by action of the Board of Managers.

13. Expense of conforming to these conditions shall be borne by the Applicant.

MOTION BY HAMPL/EBNET THAT THE REVISED CONDITIONS FOR CLOW STAMPING COMPANY PERMIT #05008 BE APPROVED.  ALL AYE, MOTION CARRIED.

MOTION BY HAMPL/EBNET THAT APPROVAL BE GIVEN FOR PERMIT #080714 TO CLOW STAMPING COMPANY FOR THE CONSTRUCTION OF A NEW STORAGE BUILDING, COVERED WALKWAY, NEW GRAVEL ROADWAY AND AN ADDITIONAL PARKING AREA CONTINGENT ON THE REQUIRED ZONING CHANGE AND RECOGNIZING THAT A CORNER OF THE EXISTING BUILDING SLAB WILL BE REMOVED TO COMPLY WITH WETLAND SETBACK.  ALL AYE, MOTION CARRIED.

MOTION BY EBNET/HAMPL THAT APPROVAL BE GIVEN TO ATTACH THE FOLLOWING CONDITIONS TO PERMIT #080714 TO CLOW STAMPING COMPANY.  ALL AYE, MOTION CARRIED.

1.  Silt fences shall be installed to protect the wetland areas prior to commencement of construction.

2.  Erosion control devices shall be installed before construction is started.

3.  A Staff Gauge will be installed in Drainage Area D.

4.  Drainage Area B and Area C outfalls shall have two hundred (200) feet of fifteen (15) inch perforated drain tile pipe.

5.  Drain tile lines shall be cleaned or replaced when sediment reaches a level of two (2) inches.

6.  Bottom markers shall be installed in Drainage Areas D and B at the lowest elevation.

7.  Sediments shall be removed from the Drainage Areas when they reach four (4) inches and disposed of according to Crow Wing County, MPCA and EPA rules.

8.  Monitoring of sediments and system performance will continue three years post construction.

9.  Permit #080714 is valid through 7/28/2011, subject to extension by action of the Board of Managers.

Monthly Bills:  MOTION BY YUND/EBNET THAT THE MONTHLY BILLS BE PAID.  ROLL CALL VOTE:  D. ARMSTRONG – AYE, T. EBNET – AYE, J. HAMPL – AYE, B. YUND – AYE, K. SVEE – NAY.

Jolly Rogers Cooperative:  K. Svee asked if the conditions of the original permit had been complied with.  The conditions were reviewed and D. Armstrong questioned the requirement of 135 sq. ft. Basal Density in Drainage Area 1.  Lot sizes range from 3,000 sq. ft. to 4800 sq. ft.

MOTION BY EBNET/YUND TO REQUIRE A NEW STORMWATER PLAN FOR THE ENTIRE JOLLY ROGERS DEVELOPMENT DUE TO THE CHANGES IN DENSITY RESULTING IN LESS IMPERVIOUS SURFACE AND LESS STORAGE OF STORMWATER.

MOTION BY SVEE/HAMPL THAT THE ISSUE BE TABLED.  ALL AYE, MOTION CARRIED.

A. W. Research Laboratories:  A. Cibuzar presented a contract for continuing to develop the Werring Procedure.  He explained that he had designed a procedure for testing rainwater runoff from different soil types.  THE BOARD OF MANAGERS INSTRUCTED A. W. RESEARCH TO TEMPORARILY STOP WORK ON THE WERRING PROCEDURE AND THE PRECIPITATION STUDY.

A. Cibuzar then presented a contract for hourly attendance at meetings.  THE BOARD OF MANAGERS CHOSE NOT TO ACT ON THE CONTRACT AT THIS TIME.

Pelican Lake Stormwater Project:  The Managers review the contract from Widseth Smith Nolting for Engineering Services which was broken down into the following tasks:

            1.  Locate & Field Survey Basin Locations             $2,500.00
2.  Development of Basin Areas & Sections                       $5,300.00
3.  Design                                                                      $2,800.00
4.  Presentation                                                              $1,900.00

K. Svee suggested that signing the contract be postponed until the meeting between Julie Klocker of BWSR and Thirty Lakes.

MOTION BY EBNET/SVEE THAT THE CONTRACT WITH WIDSETH SMITH NOLTING BE TABLED WITH THE EXCEPTION OF TASK #1 WHICH WAS PREVIOUSLY APPROVED.  ALL AYE, MOTION CARRIED.

Half Moon Saloon:  K. Svee reported that Brian Wiswell has not yet responded to the letter sent to him by registered mail.  He suggested that he will continue to attempt to contact Wiswell, or do whatever Pres. Armstrong instructs him to do.

2008 Newsletter:  The draft of the newsletter was reviewed by the Managers.  T. Ebnet made a correction and K. Svee suggested the outline of the Watershed District be colored red on the map that appears on the final page.

MOTION BY HAMPL/SVEE THAT $4,000.00 BE AUTHORIZED FOR PRINTING OF THE 2008 NEWSLETTER.  ALL AYE, MOTION CARRIED.

Revised Permit Application Form:  A draft of a new permit application form was reviewed and discussed by the Managers.  J. Hampl stated that the County has discovered errors in the Real Estate Codes for many properties.  T. Ebnet remarked that the County is supposed to be the authority for that type of information.  It was decided that the permit application should request a site map drawn to scale, and a statement about voiding the permit if the information contained on the application is false.  Permits will be valid for a period of two years.

Etc:  B. Yund started a discussion about the meeting of July 24th with Attorney Kurt Deter and the plans for Julie Klocker of BWSR to meet with the Managers.  There was discussion about A. W. Research and the data they have collected.  It was decided that the Managers will meet with A. Cibuzar to discuss contracts for the work he performs after the meeting with BWSR.

There was also discussion about having staff perform onsite inspections.  R. Franzen suggested that having staff do it would bring more consistent results.

2009 Budget:  A Budget Workshop was scheduled for Wednesday, August 20, 2008, 9:00 am in the Watershed District office.
