Thirty Lakes Watershed District
Board of Managers Meeting
Monday, June 22, 2009

Board Present:  T. Ebnet, G. Hardy, K. Svee, M. Young, B. Yund.  Absent: None.

Also present were Bob Albrecht of the Advisory Committee, and Thirty Lakes Staff M. Peisch and T. Lauer.

The meeting was called to order at 6:30 pm by President K. Svee in the office of the Thirty Lakes Watershed District, 17064 Commercial Park Road, Brainerd, MN.

Open Forum:  None.

Consent Agenda:
MOTION BY HARDY/EBNET TO APPROVE THE CONSENT AGENDA INCLUDING THE MINUTES OF THE 5/11/09 BOARD OF MANAGERS MEETING AND THE ACCOUNTS PAYABLE.  ALL AYE, MOTION CARRIED.

Lake Edward Water Quality Testing:  The Administrator met with the Board of Directors of the Lake Edward Conservation Club on Saturday, June 13, 2009.  It is important to the Lake Edward residents that water quality testing be done every year. Lake Edward is proposing to use volunteers to collect the samples and bring them into A.W. Research Lab., IF TLWD pays the lab fees.  Administrator recommends approving water quality testing every year for Lake Edward with volunteers collecting and delivering the water samples every year and TLWD will pay the lab fees every year.
MOTION BY EBNET/HARDY TO APPROVE PAYING LAB FEES FOR WATER QUALITY TESTING EVERY YEAR FOR LAKE EDWARD, IF LAKE EDWARD VOLUNTEERS TAKE AND BRING IN SAMPLES TO A.W. LAB.  ALL AYE, MOTION CARRIED.

Grams/Jensen Variance Request: property owners would like a 50’ setback instead of 75’, and buy wetland credits. There is no building envelope for property.  Entire lot is wetland. All others neighbors are 75’ back from OHW. Administrator recommends that the board take a position of opposition to this Variance Request and notify the Board of Adjustment accordingly. Administrator is recommended to be at variance meeting.
MOTION BY EBNET/YOUNG FOR ADMINISTRATOR TO WRITE A LETTER TO CROW WING COUNTY LAND SERVICES, TO OPPOSE THE VARIANCE, SAYING THERE IS NO HARDSHIP, NEIGHBORS ARE ALL 75’ BACK.  ALL AYE, MOTION CARRIED.

DNR Proposed Shoreland Rules:  Proposed shoreland rules meeting at MPCA, Wednesday, June 24, 9:30am-noon.  K. Svee and T. Lauer are planning to go to this meeting.

Mertens Cost Share Project:  Successful shoreland restoration, because of a beaver cave in along the shore. There were before and after pictures of project shown.  Using dredge fence, rocks, mulch/soil, geofabric, seeds, all according to Crow Wing SWCD.

Lakes Area Clean Waters Council:  Discussion of who the council is, what they do. They are all volunteers from agencies and citizens.  Focus is to promote Rain gardens, Rain Barrels and Shoreland Buffers.

Bass Lake 402:  36 acre lake between Round Lake and Lake Hubert.  Weed population and increased over the years, rendering the lake unsuitable for recreation.  Pictures of Lake vegetation shown.  This is a project for consideration.  Plans to meet with owners, pump and assess all septic systems around the lake, weed harvesting, and/or treat the lake with Alum (Aluminum sulfate).  Bass Lake has mostly natural shoreland.
MOTION BY EBNET/SVEE TO DO PRELIMINARY STUDIES TO SEE WHAT THE PROJECT WOULD ENTAIL, DOLLAR FIGURES, HOMEOWNER RESPONSES. ALL AYE, MOTION CARRIED.

Ditch #13:  The Lake Edward Conservation Club is requesting that TLWD consider to clean out beaver dams, cattails and other weed growth in the channel that leads from Lake Edward into the wetland area immediately north of the Y-Store. Clean out Ditch 13 from the Y-Store south to North Long Lake.  Property Owners own the ditch.  Beaver Dams were cleaned out of channel in 2005.  DNR would like us to go into the lake, clean out entire channel and make small lake behind Y-Store navigable, clean 800’ long, 15’ wide and 3’ from the mud down. This may not be able to be different from original channel plan. Ditch law may overrule DNR. There is concern of debris from Ditch 13 traveling to North Long Lake.
Have meeting with Attorney Deter, engineer, M. Peisch, K. Svee.  Crow Wing County will break out the beaver dams. Administrator will set up meeting and notify.

Pelican Lake-Breezy Point Resort:  Proposal from Westwood Professional Services was viewed.  M. Peisch and K.Svee met with Tim Ramerth of Westwood on the site.  TLWD would like to get the project completed.  Westwood is proposing $11,500 for design, information gathering, bidding, contract administration, construction observation and record survey. 3 separate phases are divided out.  The actual construction costs are separate. Sean Pratt has also been at the site.  Landecker is not being used, due to conflict of interest.  According to Ramerth, the original plan of 1986 was grossly undersized.  G. No volumes listed on original plan.  Modifications need to be done to original plan. Hardy recommends having more bids.  Svee says original plan is inadequate at this time.  Ramerth did not seem concerned about trees in middle of parking lot; there are other areas that could be modified.  Svee recommended going with engineer and getting this plan done.  Hardy concerned about amount being spent on engineer. Yund concerned with not being involved with engineer, we are not engineers.  Peisch commented that the City of Breezy Point is not comfortable spending taxpayer money on private property. 
MOTION BY HARDY/EBNET TO GET BIDS FROM 2 MORE ENGINEERS.  ALL AYE, MOTION CARRIED.
